Lalman Shukla v. Gauri Dutt
There can be no acceptance, and thus no contract, where a person performs the act constituting the reward condition without knowledge of the offer, and a pre-existing duty is no consideration.
Facts
Gauri Dutt's nephew absconded, and he sent his servants, including his munim Lalman Shukla, to search for the boy. After the servants left, Gauri Dutt issued handbills offering a reward of Rs 501 to whoever found the boy. Lalman traced and brought back the boy; he was unaware of the reward when he began the search and later sued to recover the Rs 501.

Arguments
Lalman argued that finding the boy satisfied the handbill's condition, entitling him to the reward under S8. Gauri Dutt argued that Lalman acted in performance of his duty as munim and without knowledge of the offer, so there was no acceptance and no contract.
Held
The court held that knowledge of the offer is a necessary precondition to acceptance; one cannot assent to or accept an offer of which one is unaware. Although handbills were later sent to Lalman, his act of searching arose from his employment, and an act done in discharge of an existing obligation cannot be consideration for a fresh promise. Accordingly no contract was formed and the suit for the reward failed.
Ratio decidendi
An offer must be known to the offeree before it can be accepted; performance of the offer's condition in ignorance of it is no acceptance, and the discharge of a pre-existing duty furnishes no consideration for a new agreement.
Significance
The leading Indian authority that acceptance presupposes knowledge of the offer and that existing-duty performance is not consideration; routinely cited on general offers and the meeting of minds.
